ARBITRATION FEE STRUCTURE

Overview

The Indo-US Arbitration Hub follows a transparent, ad valorem fee structure for commercial disputes, ensuring predictability and proportionality. Administrative fees and arbitrator fees are calculated based on the aggregate amount in dispute (claim + counterclaim).

All fees are payable in USD or INR, as agreed by the parties.


1. Registration Fee

  • USD 1,000 (Non-refundable)
    or

  • INR equivalent, as notified annually.

Payable at the time of filing the Notice of Arbitration.


2. Administrative Fees (Institutional Charges)

Above 20,000,000 0.75% (capped at USD 150,000)

Minimum Administrative Fee: USD 5,000
Maximum Cap: USD 150,000

Administrative fees cover:

  • Case management

  • Procedural supervision

  • Tribunal appointment assistance

  • Hearing coordination

  • Award scrutiny (where applicable)

  • Digital case platform access


3. Arbitrator Fees

Arbitrator fees are calculated based on a fee schedule unless parties agree otherwise.

Sole Arbitrator

Three-Member Tribunal

  • Each co-arbitrator: 60% of sole arbitrator scale

  • Presiding arbitrator: 120% of co-arbitrator fee

The Secretariat may adjust fees considering:

  • Complexity

  • Volume of evidence

  • Number of hearings

  • Urgency

  • Multi-party participation


4. Emergency Arbitrator Fees

  • Filing Fee: USD 5,000

  • Emergency Arbitrator Fee: USD 20,000 – 40,000

Decision typically rendered within 14 days of appointment.


5. Fast-Track Procedure Fees

Applicable for disputes below USD 2,000,000 or by agreement of parties.

  • Sole Arbitrator only

  • Reduced Administrative Fee: 75% of standard rate

  • Award within 6 months


6. Additional Costs

Parties may be required to deposit advances covering:

  • Hearing venue costs

  • Transcription services

  • Tribunal-appointed expert fees

  • Translation services

  • Travel and accommodation (if applicable)

Unused deposits will be refunded.


7. Deposits & Advances

The Secretariat will fix an advance on costs.
Failure to pay may result in suspension or termination of proceedings.

The Tribunal may allocate final costs in the award.
